Odpowiedzialność międzynarodowa karna Władimira Putina: immunitet jurysdykcyjny głowy państwa w kontekście ścigania za zbrodnie międzynarodowe

Artykuł udziela odpowiedzi na pytanie o formalnoprawne możliwości ścigania i karania sprawców zbrodni międzynarodowych. W szczególności uwaga poświęcona została prezydentowi Rosji Władimirowi Putinowi jako osobie odpowiedzialnej za zbrodnie popełnione przez siły Federacji Rosyjskiej na terytorium Ukrainy po 2022 r. Analiza porównawcza form ścigania i karania sprawców zbrodni w kontekście immunitetów głów państw prowadzi do wniosku o możliwości ukarania prezydenta Rosji przed Międzynarodowym Trybunałem Karnym i trybunałem powołanym przez organy ONZ w trakcie pełnienia obowiązków głowy państwa. Możliwości ukarania prezydenta Rosji zwiększają się, jeśliby ten przestał pełnić funkcję prezydenta. Wtedy, oprócz wyżej wymienionych, także trybunały hybrydowe oraz sądy krajowe w ramach jurysdykcji uniwersalnej, mogą zadecydować o postawieniu prezydenta Rosji w stan oskarżenia. Prawdopodobieństwo ukarania Putina jest jednak niewielkie ze względu na mocarstwowy status Federacji Rosyjskiej.

The article addresses the question of accountability for international crimes. An attention is given to Vladimir Putin, the President of the Russian Federation who is allegedly the most responsible for the crimes committed by the Russian forces in Ukraine after 2022. A comparative analysis of the forms of prosecution of crimes in the context of the immunities of heads of state leads to some conclusion. First, there is an option to judge the Russian President before the International Criminal Court and a tribunal established by the UN even during his duties as the head of state. Second, possibilities of prosecution increase if Vladimir Putin ceases to perform his duties as the president. Then hybrid tribunals and national courts under a formula of universal jurisdiction could indict the Russian president. However, the trial and punishment of Russian high officials is problematic due to the superpower status of the Russian Federation.
