Modyfikacja uprawnień zatrzymanego w poselskim projekcie nowelizacji ustawy – Kodeks postępowania karnego oraz ustawy – Kodeks postępowania w sprawach o wykroczenia

The bill proposes to amend the Code of Criminal Procedure’s definition of a suspect and to regulate the issue of a detainee’s access to contact with an advocate or a legal adviser – even before the detainee is granted the status of a suspect. In particular, the bill introduces an obligation to allow a detained person to communicate with a lawyer without the detainee having to make a relevant request, and it also envisages a departure from the possibility of reserving, in exceptional cases, the presence of the detaining officer during a direct interview between the detainee and a lawyer. In the Author’s opinion, the proposed solutions may contribute to guaranteeing a detainee a better access to legal assistance. At the same time, the author expresses substantive doubts about some of the proposed solutions, thus, in her opinion, the matter requires further legislative work.
