In the author’s opinion, the broad statutory changes concerning the Constitutional Tribunal, including the end of the term of office of the current judges of the Constitutional Tribunal and the election of new judges, are justified by the constitutional and legal situation created by the constitutional crisis. The division of tasks between the President of the Constitutional Tribunal and the General Assembly of the judges of the Constitutional Tribunal, as proposed in the analysed chapters of the Bill, is a safeguard against the excessive influence of a single-member body on the judicial activity of the Constitutional Tribunal. The proposal to elect a Constitutional Tribunal judge by a majority of 3/5 votes in the presence of at least half of the Deputies ensures a cross-party agreement. Constitutional objections may be raised, inter alia, in respect of the mode of adoption of the regulations of the Constitutional Tribunal and the proposal that the President of the Republic of Poland and the Public Prosecutor-General may submit a request for the institution of disciplinary proceedings.
