In the author’s opinion, the bill under consideration is to a large extent modelled on the Constitutional Tribunal Act of 1st August 1997. It provides for a return to regulating in a single act the issues concerning the status of the judges of the Constitutional Tribunal, as well as the principles of its work and the procedure in cases pending before it. It is one of the elements of a broader reform aimed at restoring public confidence in the jurisprudence of the Constitutional Tribunal, eliminating the defective solutions of the regulations currently in force, and clarifying issues that have raised doubts in the literature. The author comments on some of the proposed solutions, such as the proposal to introduce a qualified majority voting in the election of candidates for judges of the Constitutional Tribunal, the election of members of the disciplinary court, the regulation of the principles of publicity of hearings and the principles of composition of the benches.
