The aim of the article is to assess the legal nature of annual leave. The author analyzes the normative regulation of annual leave and draws attention to elements proving that leave is a subjective right, but also an employee’s obligation. Moreover, the author tries to point out the theoretical construction aspects of subjective law. In view of this, the article aims to answer the question whether annual leave is an employee’s right or obligation.
