Analiza postulowanych zmian sposobu uzyskiwania pozwolenia na broń w Polsce z wykorzystaniem metody komparatystycznej w studium przypadku Republiki Czech

In the first half of 2022, a draft Law on Weapons and Ammunition was brought, in which the MPs included regulations from the EP and Council Directive (EU) 2021/555 of 24 March 2021 on control of the acquisition and possession of weapons. Therefore, this work analyses, as well as compares the procedure of issuing weapons permits in Poland, which was based on the current provisions of the Law on Weapons and Ammunition and the provisions contained in the draft law proposed by the MPs, which included the regulations of the EP and Council (EU) Directive of 24.03.2021. In addition, the paper analyses the procedure for obtaining an arms permit on the basis of the current legal regulations in Poland and the proposed legal regulations in the draft in the case study of the Czech Republic. This is followed by a comparison and evaluation of the above regulations based on statistics, and finally, de lege ferenda postulates are identified to improve the legal system and strengthen safety in Poland.

Coraz więcej osób w Polsce decyduje się na uzyskanie pozwolenia na broń palną. Ich decyzja wynika m.in. z wojny w Ukrainie, czy zmniejszenia poczucia bezpieczeństwa w kraju. Niedawno został wniesiony przez posłów projekt ustawy prawo o broni i amunicji, w którym to posłowie uwzględnili regulacje z dyrektywy PE i Rady (UE) 2021/555 z dnia 24 marca 2021 r. w sprawie kontroli nabywania i posiadania broni. W pracy dokonano analizy przepisów ustawy prawo o broni i amunicji, przepisów proponowanych w poselskim projekcie ustawy oraz analizy procedury uzyskania zezwolenia na broń w Czechach. Następnie dokonano porównania i oceny powyższych regulacji w oparciu o statystyki, a na koniec wskazano postulaty de lege ferenda, celem ulepszenia systemu prawnego i wzmocnienia bezpieczeństwa w Polsce.
