W przypadku umowy deweloperskiej kluczowe znaczenie, obok jej podmiotu, ma przedmiot umowy, czyli lokal mieszkalny i dom jednorodzinny. W artykule przedstawiona została definicja lokalu mieszkalnego wraz z udziałem w nieruchomości wspólnej (jego genezą, konstrukcją prawną i algorytmem obliczania). Opisane zostało również pojęcie domu jednorodzinnego wraz z problematyką budowy ich na gruntach użytkowanych wieczyście i prawem zabudowy.
