Calculating the Deadlines Prescribed in Weeks, Months or Years in Criminal Proceedings. Commentary on the Decision of the Supreme Court of 13 November 2019, I KZP 9/19

This article analyses the issue of how to calculate the deadlines in criminal proceedings. Based on the criticism of the Supreme Court’s position expressed in the decision of 13 November 2019, I KZP 9/19, as well as the achievements of the doctrine of criminal procedural law, an attempt was made to find arguments supporting the thesis that the rule expressed in Article 123, § 1 of Polish Criminal Procedures Code, according to which the day from which the deadline is calculated is not included in this calculation, can also be applied for calculating the deadlines specified in weeks, months or years.

W artykule analizie poddano zagadnienie sposobu liczenia terminów w procesie karnym. W oparciu o krytykę stanowiska Sądu Najwyższego, wyrażonego w postanowieniu z 13.11.2019 r., I KZP 9/19, jak również dorobek doktryny prawa karnego procesowego, podjęto próbę znalezienia argumentów przemawiających na rzecz tezy o możliwości zastosowania reguły wyrażonej w art. 123 § 1 Kodeksu postępowania karnego, zgodnie z którą do biegu terminu nie wlicza się dnia, od którego liczy się dany termin, również do obliczania terminów oznaczonych w tygodniach, miesiącach i latach.
