Between Warsaw and Vatican City- legal and historical analysis on the occasion of the 30th anniversary of the conclusion of the concordat between the Holy See and the Republic of Poland

July 28, 2023 will mark 30 years since the conclusion of the concordat between the Holy See and the Republic of Poland. Although the conclusion of this agreement took place in 1993, it actually entered into force in 1998. Between these events took place the adoption of the new 1997 Constitution of the Republic of Poland, adapted to the democratic state of law, whose Article 25, paragraph 4. directly indicates that "The relations between the Republic of Poland and the Roman Catholic Church shall be determined by international treaty concluded with the Holy See, and by statute". The purpose of this article will be a legal analysis of the current solutions arising from the concordat based on the Polish Basic Law, the body of doctrine and case law. Although the article has a legal character, it is impossible not to refer to the historical and political aspects of the conclusion of this international agreement. This is because there is no doubt that the 1993 concordat was of significant importance in the history of the Third Republic of Poland, and one of the protagonists and the face of this agreement is Prime Minister Hanna Suchocka.

Dnia 28 lipca 2023 r. minie 30 lat od zawarcia konkordatu między Stolicą Apostolską a Rzecząpospolitą Polską. Choć do zawarcia tej umowy doszło w 1993 r., to faktycznie weszła ona w życie w 1998 r. Między tymi wydarzeniami miało miejsce przyjęcie nowej, dostosowanej do demokratycznego państwa prawnego Konstytucji RP z 1997 r., której art. 25 ust. 4. wprost wskazuje, że „stosunki między Rzecząpospolitą Polską a Kościołem katolickim określają umowa międzynarodowa zawarta ze Stolicą Apostolską i ustawy”. Celem niniejszego artykułu jest analiza prawna obowiązujących rozwiązań wynikających z konkordatu w oparciu o polską ustawę zasadniczą, dorobek doktryny i orzecznictwo. Choć artykuł ma charakter prawniczy, to nie sposób nie odnieść się do aspektów historycznych i politycznych zawarcia tej umowy międzynarodowej. Nie ulega bowiem wątpliwości, że konkordat z 1993 r. miał istotne znaczenie w dziejach III RP, a jedną z bohaterek i twarzą niniejszej umowy jest premier Hanna Suchocka.
