Kumulowanie stanowisk w organach spółek z udziałem Skarbu Państwa

The aim of the article is to indicate problems associated with issues of combining membership in management board with some other functions in bodies of another companies. Presented deliberation concentrated on interdisciplinary analytical examinations devoted in depth analysis of the wide spectrum of organizational-legal conditions and provisions of law enabling oneperson accumulate positions in bodies of companies with State Treasury participation, as well as created by them subsidiaries. Author paid special attention to issues concerning bans resulting from provisions of the anticorruption and chimney act.The article is an attempt to answer the important question about real objectives and motives for appointing the same persons to authorities of many companies with the capital contribution of state treasury. Additionally, were discussed key factors determining effective realization of control functions by the supervisory board: personal competences, devoted time, independence, impartiality.
