Justice in the #metoo times

Centralnym zagadaniem mojego tekstu jest pytanie o to, jakiej sprawiedliwości mogą domagać się ofiary przemocy seksualnej. Badam, jaka wizja sprawiedliwości wyłania się z działań ruchu #metoo i debat wokół tych działań, na ile wpisuje się ona (lub nie) w obowiązujący system prawny. Stawiam tezę, że działania kobiet inspirowane #metoo wychodzą zdecydowanie poza karny system dochodzenia sprawiedliwości w kontekście przemocy seksualnej. W odpowiedzi na wysoką nieskuteczność tego systemu i jego nieprzystawalność do doświadczenia ofiar można interpretować #metoo jako próbę poszukiwania nowych sposobów na realizację sprawiedliwości dla kobiet, tworzenie i praktykowanie utopijnego programu sprawiedliwości.

Central for my paper is a question concerning realization of justice for women experiencing sexual violence. The context is the #metoo movement and the idea of justice that it envisions. I am investigating how the cases which emerged during the movement could not find its finale in the courts and left the victims without redress. I am making a wager that the actions of women within the #metoo movement trespass the current criminal mode of exercising justice in the context of sexual violence. I see the #metoo movement as a reaction for the failure of criminal system to deliver justice and the fact that it is ill-suited to the experience of victims of sexual violence. Hence the #metoo movement can be interpreted both as a challenge to existing system and an attempt to establish new ways of realizing justice for women. It can be seen a vision and practice of a new, progressive and utopian justice curriculum.
