Individuals rights and freedoms of the Constitution of the Republic of Poland of 1997

Scope of my master’s thesis relates to the individual rights and freedoms. The discussion is based on the example of the records of the Constitution of the Republic of Poland of 1997.Reflections on this subject I began by defining the concept of human rights while I was showing the process of development and transformation of human rights and freedoms from antiquity to contemporary times. The next chapter describes some legal acts that are the foundation of human rights, afterwards the basic principles derived from these regulations, which were work out by international organizations are presented . Then I classified a set of rights and freedoms taking into account the diversity of divisions occurring in the literature. In the last part of my master’s thesis I focused on describing some of the individual rights and freedoms in detail, for example the right to physical integrity and personal liberty, the right to a fair trial, the right to protect: privacy, family, honor and good name as well as the rights of freedom of movement within the territory of the state and right of choosing the place of residence and stay, taking into account polish constitutional norms, law courts, as well as international instruments.

Tematyka pracy odnosi się do praw i wolności osobistych jednostki, których omówienie opiera się na przykładzie zapisów Konstytucji Rzeczypospolitej Polskiej z 1997 roku. Rozważania na ten temat rozpoczęłam od zdefiniowania pojęcia praw człowieka z równoczesnym ukazaniem procesu rozwoju oraz przeobrażenia jakim poddawane były prawa i wolności człowieka począwszy od starożytności, aż po czasy współczesne. Kolejny rozdział poświęciłam na omówienie aktów prawnych stanowiących fundament praw człowieka, a także na zwrócenie uwagi na podstawowe zasady wynikające z tych unormowań, które to zostały wypracowane przez organizacje o zasięgu międzynarodowym. Następnie dokonałam klasyfikacji zbioru praw i wolności z uwzględnieniem różnorodności podziałów występujących w literaturze. W pozostałej części pracy skupiłam się na szczegółowym omówieniu wybranych praw i wolności jednostki m. in. prawa do nietykalności i wolności osobistej, prawa do sądu, prawa do ochrony życia prywatnego, rodzinnego, czci i dobrego imienia oraz prawa swobody poruszania się po terytorium państwa i wyboru miejsca zamieszkania i pobytu, uwzględniając unormowania konstytucyjne RP, orzecznictwo sądów, a także akty międzynarodowe.
