Kulturowe i prawne aspekty ochrony dziedzictwa materialnego na przykładzie "Szlaku Architektury Drewnianej na Ziemi Pszczyńskiej"

This thesis deals with the topic of protection of tangible cultural heritage. Cultural route of Wooden Architecture in Pszczyna region is an example of the analysis of domestic and international law concerning regionalism and cultural heritage protection. The main objective of this thesis is drawing attention to the important issue of protection of tangible heritage which constitutes a testimony of the past and defines the actions of contemporary generations.The first chapter is devoted to the international aspects of the protection of tangible heritage. The analysis is based on legal documents, projects and programs of international organizations such as UNESCO, the European Commission and the Council of Europe. The second chapter brings up the topic of national facets of the regulation of cultural heritage and of institutions supervising this protection. This chapter defines also different concepts connected with national heritage preservation such as historic monument, cultural property or cultural landscape. The third chapter explains the terms of region, regionalisation and regionalism which presume the protection of regional heritage. The fourth chapter is devoted to the Cultural Route of Wooden Architecture in Pszczyna region which exemplifies the enlivening of regionalistic tendencies in Pszczyna region . This cultural route, which is considered in terms of the guidelines of the Program of Cultural Routes of the Council of Europe , is the basis for the analysis of issues which are discussed in the first three chapters and which are also connected with the regulation of monument protection and the phenomenon of regionalism. Cultural Route of Wooden Architecture in Pszczyna region is a symbol of exchanging experiences between regional communities (where not all communities are genuinely Silesian). Owing to its constant development, this route promotes Pszczyna (as a city of monuments) and local traditions and customs. Due to the fact that this region is not of a vast territory, the cultural route of Pszczyna has never been given a proper attention as far as its existence in terms of the law is concerned. This thesis, though to a limited extent, is an attempt to fill in this specific gap and draw attention to the regional heritage of Pszczyna region.

Niniejsza praca zajmuje się tematyką ochrony materialnego dziedzictwa kultury. Przykładem analizy prawnej (krajowej i międzynarodowej) ochrony dóbr kultury oraz regionalizmu jest Szlak Architektury Drewnianej na Ziemi Pszczyńskiej. Głównym celem pracy jest zwrócenie uwagi na istotną kwestię ochrony materialnego dziedzictwa, które jest świadectwem przeszłości oraz definiuje działania kolejnych pokoleń.Rozdział pierwszy pracy został poświęcony międzynarodowym aspektom ochrony materialnego dziedzictwa. Podstawą tej analizy są akty prawne, projekty i programy działań międzynarodowych organizacji, takich jak UNESCO, Komisja Europejska i Rada Europy. Drugi rozdział podejmuje kwestie krajowych aspektów regulacji ochrony dziedzictwa oraz instytucji zarządzających tą ochroną. W rozdziale tym zdefiniowane są także pojęcia łączące się z ochroną krajowego dziedzictwa – zabytek, dobro kultury, krajobraz kulturowy. Trzeci rozdział wyjaśnia pojęcia regionu, regionalizacji i regionalizmu, które zakładają ochronę regionalnej spuścizny. Czwarty rozdział został poświęcony Szlakowi Architektury Drewnianej na Ziemi Pszczyńskiej, który jest przykładem ożywienia tendencji regionalistycznych w regionie pszczyńskim. Pszczyński szlak kulturowy, rozpatrywany w ramach założeń projektu Szlaków Kulturowych Rady Europy, stanowi podstawę analizy kwestii (omówionych w pierwszych trzech rozdziałach) z zakresu regulacji ochrony zabytków i zjawiska regionalizmu. Pszczyńska trasa architektury jest symbolem wymiany doświadczeń regionalnych społeczności (nie tylko społeczności śląskich), a poprzez swój rozwój promuje Pszczynę (jako miasto zabytków) oraz lokalną tradycję i zwyczaje. Z racji zajmowania niewielkiego obszaru, pszczyńskiemu szlakowi kulturowemu nie poświęcono większej uwagi która dotyczyłaby jego funkcjonowania w ramach prawa. Niniejsza praca – choć w ograniczonym zakresie – próbuje zapełnić tę swoistą lukę i zwrócić uwagę na regionalne dziedzictwo Pszczyny.
