The recall of a mayor by local referendum (2002 - 2010)

W 2002 roku wprowadzono w Polsce bezpośrednie wybory wójtów, burmistrzów i prezydentów miast. Takie rozwiązanie, zgodnie z Konstytucją RP z 1997 roku, skutkowało też zmianą sposobu odwoływania tych organów przed upływem kadencji. Od 2002 roku odbywa się ono w drodze referendum lokalnego. Niniejsza praca jest próbą analizy tego zjawiska w odniesieniu do prezydentów miast za lata 2002-2010. Struktura pracy odwzorowuje poszczególne etapy prowadzące do referendum. Począwszy od przybliżenia sylwetek prezydentów, których zamierzano odwołać i ich osadzenia w lokalnym środowisku politycznym, poprzez charakterystykę podmiotu, podejmującego się inicjatywy w tej sprawie oraz przyczyn, które doprowadziły do wszczęcia prób usunięcia włodarzy z zajmowanych stanowisk, po analizę wyników przeprowadzonych głosowań. i ukazanie dalszych losów prezydentów. Opracowanie to porusza też problematykę ustrojowych regulacji dot. referendum lokalnego, będących fundamentem omawianego zagadnienia.

In 2002 Polish Government introduced direct election of mayors, provosts and city presidents. These new regulations, in accordance with the 1997 Polish Constitution, consequently restructured recall procedures for city officials prior to the end of their term. In the aftermath of these changes, recalls of elected officials operated on the basis of local referendums. The following article attempts to analyze this political phenomenon, drawing on various examples of city presidents in Poland between 2002-2010. The article maps the various stages of recall procedures ultimately leading to a referendum, beginning with a closer examination of the profiles of the officials in question, their orientation within local political systems, as well as the characteristics of the recalling subject, whose initiative commenced the referendum in question. Furthermore, the article explores the origins of recall processes, taking into consideration the significance of poll and election results, and including a relevant discussion of the officials‘ further fate. This analysis scrutinizes the broader implications of regulations concerning local referendums, since these make up the fundamental framework of the question at hand.
