Appointment and responsibility of The Council of ministers in Poland

Celem pracy magisterskiej pt. „Powoływanie i odpowiedzialność Rady Ministrów w Polsce” jest przedstawienie procedur powoływania Rady Ministrów oraz przedstawienie trybów egzekwowania odpowiedzialności wobec członków Rady Ministrów i całego rządu.W pierwszym rozdziale pracy magisterskiej została przedstawiona Rada Ministrów i Prezydent RP jako organy władzy wykonawczej. Następnie zostały opisane relacje ustrojowe pomiędzy tymi dwoma organami władzy wykonawczej. W dalszych rozdziałach została opisana pozycja ustrojowa Rady Ministrów oraz wyodrębniona pozycja Prezesa Rady Ministrów jak i pozycja ustrojowa ministra. Kolejny rozdział pracy opisuje konstytucyjny skład Rady Ministrów. Szczegółowo zostały opisane procedury powoływania rządu.Został też opisany problem zmiany członków Rady Ministrów jak również przedstawiona procedura na podstawie której, zmiany te mogą się odbywać. Ostatni rozdział pracy został poświęcony opisaniu odpowiedzialności jaką ponosi rząd za swoje działania. Rozdział ten przedstawia rodzaje odpowiedzialności jaką ponoszą członkowie Rady Ministrów czyli polityczną odpowiedzialność przed parlamentem – solidarna i indywidualna oraz odpowiedzialność konstytucyjna przed trybunałem stanu – aspekty podmiotowy, przedmiotowy oraz procedurę pociągnięcia do tej odpowiedzialności członka Rady Ministrów.

The aim of thesis “Appointment and responsibility of The Council of Ministers in Poland” is to present the procedures of appointing the council of ministers and procedures of executing the responsibility from members of Council of Ministers and entire government.In the first chapter of thesis Council of Ministers and President were presented as a organs of executive. In the next part were presented sructural relations between those parties of executive. In continuation of thesis structural position of The Council of Ministers was described and positions of Prime Minister and minister were separated.The next chapter describe constitutional composition of the Council of Ministers. Procedures of founding the government were descibed in a detail. The problem of changing the members of The Council of Ministers was described and also the procedure of those changes.The last chapter of thesis was dedicated to describe the responsibility of government for its activity. This chapter presents types of responsibility of members of Council of Ministers it means the political responsibility in front of parliament – joint and individual liability and constitutional responsibility in front of State Tribunal – subjective aspect and procedure of hold the member of Council of Ministers liable.
