The main subject of my thesis is the issue of exclusion of contractors from the procedure of public procurement in the light of freedom to provide services. Starting with a brief review of the history and theory of public procurement and freedom to provide services, the thesis discusses the relationship between these topics. There are also some information about in-house procurement. Mainly the thesis is based on jurisprudence of the Court of Justice, with particular emphasis on the Teckal doctrine and evolution that has taken place at a later time. In the last chapter, you can find information about the grounds for exclusion of contractors in Poland, administrative discretion, the operation of in-house procurement and public-private partnership.

Głównym przedmiotem mojej pracy magisterskiej jest zagadnienie wykluczenia wykonawców z postępowania o udzielenie zamówienia publicznego w świetle swobody świadczenia usług. Zaczynając od krótkiego przeglądu historii i teorii zamówień publicznych oraz swobody świadczenia usług, praca opisuje zależności pomiędzy tymi tematami. Omówione zostało również istotne nawiązanie do zamówień in-house. Głównie praca oparta jest na orzecznictwie Trybunału Sprawiedliwości, ze szczególnym uwzględnieniem doktryny Teckal i ewolucji jaka nastąpiła w późniejszym czasie. W ostatni rozdziale natomiast można znaleźć informacje dotyczące podstaw wykluczenia wykonawców w Polsce, uznania administracyjnego, funkcjonowania zamówień in-house oraz partnerstwa publiczno-prywatnego.
