The European Court of Human Rights concerning the structural problems on the example of abuse of detention in Poland

The system of the European Convention on Human Rights is in jeopardy because the European Court of Human Rights is overloaded with applications. The structural problems cause a large number of repetitive applications. The main structural problem in Poland is unlawful detention and excessive length of detention on remand. It is necessary to find a solution of this problem.

System Europejskiej Konwencji Praw Człowieka jest w niebezpieczeństwie ponieważ Europejski Trybunał Praw Człowieka nie może poradzić sobie z nadmierną liczbą skarg przed nim zawisłych. Źródłem dużej liczby skarg powtarzających się są problemy strukturalne. Głównym problemem strukturalnym w Polsce jest nadużywanie tymczasowego aresztowania. Należy znaleźć rozwiązanie tego problemu.
