Protection of rights of national minorities in the international law and domestic

Praca dotyczy zagadnienia ochrony praw mniejszości narodowych w prawie międzynarodowym i polskim. Przedstawione w niej zostały problemy definicyjne pojęcia „mniejszość narodowa”, elementy charakteryzujące mniejszość, które powinny znaleźć się w każdej definicji, ponadto przywołane zostały definicje pojęcia tworzone przez organizacje międzynarodowe, oraz wybrane ustawodawstwa krajowe ze wskazaniem osób należących do mniejszości narodowych w omawianych państwach. Sporo miejsca poświęcone zostało międzynarodowym systemom ochrony praw mniejszości narodowych, omówione zostały systemy ochrony praw w ramach systemu wersalskiego, KBWE/OBWE, ONZ, Rady Europy oraz UE. W każdym z systemów wyodrębniono gwarancje prawne, instytucjonalne i (jeśli takowe były) jurysdykcyjne ochrony. Wiele miejsca poświęcono ustawodawstwu polskiemu. Przywołane zostały przepisy odnoszące się do praw mniejszości narodowych zawartych w konstytucji, ustawach zwykłych, oraz rozporządzeniach. Wskazano jakie wymogi musi spełnić dana grupa by mogła zostać uznana za mniejszości narodową lub etniczną w Polsce. Enumeratywnie wyliczono jakie mniejszości narodowe i etniczne zamieszkują w Polsce, oraz wnikliwej analizie poddano przywileje mniejszości narodowych w sferze językowej, oświaty, kultury i wyznania oraz w życiu politycznym.

The work is regarding the issue of the protection of rights of national minorities in the international law and Polish. In it definitional problems of the notion were presented "national minorities", elements being characteristic of a minority which should be in every definition, moreover were summoned definitions of the concept created by international organizations, and chosen national legislations with indicating persons belonging to national minorities in discussed states. Quite a lot of place was devoted to international systems of the protection of rights of national minorities, systems of the protection of rights were discussed as part of the Versailles system, KBWE/OBWE, the UN, the European Council and the EU. legislative, institutional warranties were distinguished in each of systems and (if such were) jurisdictional protections.Lot of room they devoted to the Polish legislation. Recipes referring to laws of national minorities included in the constitution, ordinary acts, and regulations were quoted. What requirements were shown a given group must fulfil so that she can be recognized as minorities national or ethnic in Poland. Enumeratywnie was enumerated what national minorities and ethnic they are settling in Poland, as well as privileges of national minorities were subjected to the indepth analysis in the linguistic sphere, educations, cultures and faith and in the political life.
