Legal proceedings in matrimonial cases - divorce and separation on demand of one of the spouses

The purpose of this master's thesis is to present a description of the procedure in cases of divorce or legal separation. The first chapter contains a general description of the procedure in cases of divorce or separation, as a separate proceeding, indicates who may be party to such proceedings and what is the jurisdiction and composition of the court in these cases. The second section provides a description of the substantial prerequisites of divorce and separation, governed by the Family and Guardianship Code. In the third chapter the author tries to present a chronological course of proceedings for divorce or legal separation, from its initiation, through the first-instance hearing, a description of the mediation, the possibility of suspension or discontinuance of the proceeding, a description of hearing of evidence, pointing to the exclusive rule of conduct for divorce or legal separation, description of the proceedings to secure claims, a form of sentencing, and ending on the identification of possible appeal measures. The isolated fourth chapter shows the effects of the divorce decree applies after the validation of a judgment.

Celem niniejszej pracy jest przedstawienie opisu postępowania w sprawach o rozwód lub o separację. Rozdział pierwszy zawiera ogólną charakterystykę postępowania w sprawach o rozwód lub o separację, jako postępowania odrębnego, wskazuje na to, kto może być stroną takiego postępowania oraz jaka jest właściwość i skład sądu w tych sprawach. Drugi rozdział stanowi opis materialnych przesłanek rozwodu i separacji, uregulowanych w Kodeksie rodzinnym i opiekuńczym. W trzecim rozdziale autorka stara się chronologicznie przedstawić tok postępowania o rozwód lub o separację, począwszy od jego wszczęcia, poprzez przebieg rozprawy, opis postępowania mediacyjnego, możliwości zawieszenia lub umorzenia postępowania, opis postępowania dowodowego, wskazanie na zasadę wyłączności postępowania o rozwód lub o separację, opis postępowania zabezpieczającego, formę wyrokowania, a skończywszy na wskazaniu możliwych środków odwoławczych. Wyodrębniony rozdział czwarty ukazuje skutki, jakie odnosi wyrok rozwodowy po jego uprawomocnieniu.
