Public–private partnership

Praca magisterska dotyczy zagadnienia partnerstwa publiczno-prywatnego, w której poruszono najważniejsze kwestie dotyczące wyboru partnera dla jednostki samorządu terytorialnego, omówiono składniki umowy partnerskiej, a także przedstawiono możliwe modele współpracy i ich zastosowanie w poszczególnych państwach europejskich. Autor skupił się na ustawie kształtującej w sposób ramowy zagadnienie realizacji inwestycji partnerskiej i jej funkcjonowaniem w praktyce. Przedstawia również poglądy doktryny na temat problemów pojawiających się w trakcie stosowania przepisów mających zastosowanie przy realizacji partnerstwa publiczno-prywatnego, posiłkując się przy tym orzecznictwem Trybunału Sprawiedliwości i wytycznymi Komisji Europejskiej. Na koniec pracy przedstawiono ocenę i dane statystyczne dotyczące dotychczasowego wykorzystania partnerstwa w polskim porządku prawnym.

Master's thesis concerns the question of public-private partnership, which addresses the key issues regarding the selection of a partner for local government units, components of the partnership agreement and the possible cooperation models and their application in various European countries. The author focused on the law shaping the issue of the investment partnership, and its functioning in practice. It also presents the views of the doctrine of the problems arising from the application in practice of the rules applicable in the implementation of public-private partnership, guided by the jurisprudence of the Court of Justice and European Commission guidelines. At the end of the assessment author presents statistical data on current use of partnerships in the Polish legal system.
