Special protection of continuity of the employment relationship of Sejm deputies and senators

Problematyka pracy jest skupiona wokół tematu szczególnej ochrony trwałości stosunku pracy posła i senatora, którą odnajdujemy, poza kodeksem pracy, w ustawie o wykonywaniu mandatu posła i senatora. Przedstawiciele narodu w parlamencie są jedną z kategorii pracowników korzystających ze wzmożonej ochrony prawnej ich stosunku pracy. Ustawodawca wprowadził regulację, która kształtuje relacje pracodawcy i pracownika, który w wyniku wyborów powszechnych został wybrany do jednej z izb parlamentu. Pracownik taki ma prawo do skorzystania z urlopu bezpłatnego na czas sprawowania mandatu, z kolei na pracodawcy ciąży obowiązek udzielenia pracownikowi takiego urlopu. Celem pracy jest ukazanie charakteru szczególnej ochrony trwałości stosunku pracy posłów i senatorów, analiza ukształtowania warunków zatrudnienia po zakończeniu przez parlamentarzystę urlopu bezpłatnego oraz przedstawienie odmienności instytucji urlopu bezpłatnego w celu wykonywania mandatu posła lub senatora od instytucji urlopu bezpłatnego zawartej w kodeksie pracy. Autor poddał krytycznej analizie obowiązujące regulacje prawne oraz wysunął postulat zmian legislacyjnych wobec zaprezentowanego stanowiska negatywnej oceny zbyt daleko posuniętej ochrony trwałości stosunku pracy posła i senatora.

This thesis focuses on the subject of the special protection of continuity of the employment relationship of Sejm deputies and senators to be found, apart from the Labour Code, in the act on the performance of the mandate of a Sejm deputy and senator. The representatives of the nation in the parliament are one of the categories of employees benefiting from the increased legal protection of their employment relationship. The legislator has introduced a regulation shaping the relationship between the employer and the employee who, as a result of public elections, has been elected to one of the parliament houses. Such an employee is entitled to use the unpaid leave for the period of mandate and the employer is obliged to grant such a leave to the employee. The objective of the thesis is to present the nature of the special protection of continuity of the employment relationship of the Sejm deputies and senators, analysis of the employment conditions upon the completion of the unpaid leave of the member of the parliament as well as presentation of the distinctness of the unpaid leave institution for the purpose of performance of the mandate of a Sejm deputy or senator from the unpaid leave institution provided for in the Labour Code. The author has subject to critical analysis the governing legal regulations as well as has set forth the postulate regarding legislative changes pertaining to the presented stance of negative assessment of the excessive protection of the continuity of the employment relationship of the Sejm deputies and senators.
