Evolution of the constitutional judiciary in Poland

The aim of the paper is to carry out a political science analysis of the the functioning of Poland's Constitutional Court and its relations with other participants in a political system, and the role of the Constitutional Court in the transformation of the political system. This reflections focus on three area : institutional, personal and functional. Polish Constitutional Court has functioned in varius political system and has been able to adpat to their specific features. Constitutional Court popularized the idea of the rule of law, were a "non-fiction" instrument of power. The Court played different role during the transformation of the political system, Its activity went beyond the framwork etsblished in stable democracies. Since the adoption of the 1997 Constitution, the Cour has performed function of the "veto player". Constitutional Court also indicertly influences the decision-making process.Today the Constitutiona Court is the most trusted institution in Poland among the institutions responsible for making the law.

Celem pracy jest dokonanie analizy funkcjonowania Trybunału Konstytucyjnego w Polsce i ewolucji modelu normatywnego, na którym instytucja ta opierała swoją działalność. Omówione zostały relacje między Trybunałem a innymi uczestnikami systemu władzy w sytuacji dynamicznych przemian ustrojowych i ich wpływ na upadek systemu PRL. Praca skupia się zarówno na aspekcie instytucjonalnym i funkcjonalnym jak i personalnym. Przedstawione zostały różne role, które odgrywał Trybunał Konstytucyjny w omawianym okresie, od organu popularyzującego ideę państwa prawnego, stanowiącego namiastkę demokratycznej instytucji państwowej ograniczającej arbitralność władz, przez organ stabilizujący nowo powstały ustrój demokratyczny, aż po obecną formę jego działania, jako gracza blokującego wpływającego na proces podejmowania politycznych decyzji. Umiejętność dostosowania się do politycznych i prawnych warunków sprawiła, że po prawie trzech dekadach działalności Trybunał Konstytucyjny cieszy się nadal dużym zaufaniem społecznym.
