Wybrane instytucje przygotowania inwestycji drogowych

Moja praca magisterska ma za zadanie opisać w sposób kompleksowy instytucje przygotowania inwestycji drogowych. Z braku miejsca jednak wybrałem trzy, moim zdaniem najistotniejsze z nich. Rozdział pierwszy stanowi wstęp do dalszych rozważań. Jest w nim zawarta definicja inwestycji drogowej oraz opisany proces inwestycyjno-budowlany. W rozdziale drugim opisuję mechanizmy służące ochronie środowiska, a w szczególności instytucję oceny oddziaływania na środowiska. Jest to bardzo istotne zagadnienie, ponieważ inwestycja drogowa prawie zawsze wpływa negatywnie na teren, na którym jest realizowana. Kolejną opisywaną instytucją jest decyzja administracyjna zezwalająca na realizację inwestycji drogowej. Jest to instytucja w prawodawstwie polskim nowa oraz bardzo skomplikowana. Na jej mocy inwestycja drogowa może przejść w fazę realizacji. Czwarty rozdział traktuje o nabywaniu nieruchomości pod inwestycję drogową. Opisuję w nim mechanizmy przeniesienia prawa własności do nieruchomości oraz egzekucji obowiązku jej opuszczenia. Rozdział piąty i ostatni stanowi podsumowanie rozważań, zawartych w czterech rozdziałach pierwszych.

My master's thesis is to describe in a comprehensive way institutions of preparing road investments. For lack of space, however, I chose three, in my opinion, the most important of them. The first chapter is an introduction to further consideration. It is included in the definition of road investment and described the process of investment and construction.The second section describes the mechanisms for the protection of the environment, in particular the institution of environmental impact assessment. This is a very important issue, because the road investment almost always has a negative impact on the area in which it is implemented. Another described institution is the an administrative decision authorizing the implementation of the road investments. It is an institution in Polish legislation, new and very complex. Under its provisions, road investment can go into the implementation phase. The fourth chapter deals with the acquisition of immovables for investment road. I describe in it the mechanisms of conveyance of real property and the enforcement of the obligation to leave it. The fifth and final section summarizes the considerations contained in the first four chapters.
