Bank secrecy

The Master’s Thesis presents the problem of bank secrecy in Polish law. The purpose of the thesis is to answer the question whether the contemporary law regulations provide sufficient information protection for the bank’s customers. The author demonstrates the origins of bank secrecy in Polish law and attempts to specify the extent of bank secrecy by means of defining the entities obliged to satisfy the bank secrecy requirements, defining the information liable to protection as well as its time limits. In the further part of the thesis, the problem of legislative exceptions to bank secrecy is demonstrated. Furthermore, the code of conduct in case of violation of bank secrecy is presented .The final part of the thesis illustrates the relation between the regulations concerning bank secrecy and protection of personal data.

Niniejsza praca magisterska omawia problem tajemnicy bankowej w prawie polskim. Celem pracy jest odpowiedź na pytanie czy obecne regulacje prawne zapewniają dostateczną ochronę informacjom udzielanym bankowi przez jego klientów. Autor przedstawia genezę tajemnicy bankowej w prawie polskim oraz podejmuje próbę określenia zakresu tajemnicy bankowej przez określenie podmiotów zobowiązanych do zachowania tajemnicy bankowej, określenia informacji podlegających ochronie oraz granic czasowych jej obowiązywania. W dalszej części pracy przedstawiono problem ustawowych wyjątków od tajemnicy bankowej oraz omówiono zasady odpowiedzialności za jej naruszenie. Ostatnia część pracy prezentuje relacje pomiędzy przepisami o tajemnicy bankowej a ochroną danych osobowych.
