Monument protection law in the II Republic of Poland

Praca poświęcona jest historii prawnych instytucji ochrony zabytków w Polsce międzywojennej, z uwzględnieniem perspektywy prawnoporównawczej, zarówno w aspekcie wertykalnym, jak i horyzontalnym. Historycznoprawny charakter pracy wymagał, aby jej zakresem objąć także zarys początków prawa ochrony zabytków na ziemiach polskich i na świecie, jak również regulacje obowiązujące na terenach poszczególnych zaborów w początkowym okresie istnienia II Rzeczypospolitej. Dalsza część opracowania poświęcona jest prześledzeniu regulacji prawnych dotyczących ochrony zabytków poprzez porównanie fundamentalnych dla przedmiotu pracy aktów prawnych: dekretu Rady Regencyjnej z 1918 roku i rozporządzenia Prezydenta z 1928 roku. Oprócz elementów opisujących i porządkujących dotychczasowy stan badań nad problemem, praca zawiera autorskie spojrzenie na ówczesne prawodawstwo przez pryzmat przepisów obecnie obowiązujących połączone z próbą oceny, w jakim stopniu postanowienia te okazały się trwałe i aktualne po dzień dzisiejszy, a które z nich nie przetrwały próby czasu. Powyższe wiąże się z koniecznością analizy zakresu przedmiotowego i podmiotowego ochrony obiektów zabytkowych poprzez analizę pojęcia zabytku, przepisów karnych i karnoadministracyjnych, form i ram czasowych ochrony, regulacji dotyczących wywłaszczenia, unormowań szczególnych dla ruchomości i nieruchomości oraz przedstawienia zróżnicowania przepisów o ochronie zabytków w zależności od statusu właściciela (osoba prawa prywatnego, publicznego lub kanonicznego).

The paper describes a history of monument protection institutions in interwar Poland in comparative perspective, in view of both vertical and horizontal aspects. Legal-historical character of the paper required to include within its scope also the outline of the beginnings of monument protection law on polish territories and in the world, as well as legal regulations in force on the territories of different partitions in the initial period of the II Republic’s of Poland existence. Further part of the paper consists of analysing legal regulations on monument protection by comparing the laws fundamental to the subject matter: Regency Council decree of 1918 and President’s decree of 1928. Besides elements describing and systematising a present state of research on the topic, the paper includes the author’s view of legislation of the time, taking into account legal regulations being in force at present and combined with an attempt to evaluate to what extent these regulations turned out to be durable and up-to-date, and which of them have not survived. This brings about the necessity to analyse the objective and subjective scope of monument protection through analysing the notion of monument, penal and administrative penal regulations, forms and time frames of protection, regulations on expropriation, particular regulations on movables and real estates, as well as presenting diversification of monument protection regulations, depending on the owner’s status (private law, public law or canonical law person).
