Sądy rabinackie we współczesnym Izraelu - historia, funkcjonowanie oraz analiza systemowa.

Praca opisuje system sądownictwa rabinackiego we współczesnym Izraelu, ustawy, na podstawie których on działa, jego praktykę oraz historię.System ten jest równoległym systemem sądownictwa państwowego w Izraelu, a sprawy, jakie on rozstrzyga nie są tylko sprawami z zakresu prawa religijnego. Istnieje wobec tego sytuacja, w której jedna sprawa może zostać rozpatrywana przez dwa zupełnie różne od siebie sądy, a niereligijni obywatele zmuszeni są rozwiązywać niektóre sprawy z zakresu prawa rodzinnego zgodnie z prawem religijnym.W pracy autorka starała się znaleźć odpowiedzi na pytania, na ile sądy te należą do systemu władzy sądowniczej, a na ile są od niej niezależne, a także na ile rzeczywistość ich funkcjonowania odbiega od teorii.Praca została napisana w oparciu o izraelskie akty prawne oraz opublikowane wyroki sądów rabinackich.

Thesis concerns about the rabbinical courts system in contemporary Israel, its law, praxis and history.In Israel exsist two separate but consolidated systems of jurisdiction. One is civil courts' system and the second – religious. The cases, which are adjudicated by the religious courts are not only religious, but also are connected with family law, contracts, alimony etc. So, according to this situation, one case could be presented before both courts and non-religious citizens are forced by law to go with some of their family law problems to the rabbinical court, which, of course, use the religious law, mostly.In the thesis, author tried to find answers for questions; how deeply rabbincal courts are connected with the judiciary or how independent they are, and is the praxis of them different than the theory in the bills?The paper is based on the israeli law acts and published judgements of rabbinical courts.
