Strona podmiotowa czynu zabronionego w polskim kodeksie karnym

Autor analizuje poszczególne formy strony podmiotowej czynu zabronionego które występują na gruncie polskiego kodeksu karnego. Praca magisterska została podzielona na pięć części. W pierwszej z nich ukazane zostały normatywne koncepcje winy. Część druga poświęcona została konstrukcji czynu zabronionego charakteryzującego się umyślnością. Wyjaśniono istotę zamiaru, świadomości, motywu i winy. Autor szczegółowo opisuje koncepcje traktujące o naturze zamiaru wynikowego. W kolejnym rozdziale ukazano odmiany zamiaru skonstruowane przez doktrynę i nadal używane przez orzecznictwo. Dodatkowo scharakteryzowano grupy przestępstw znanych jako przestępstwa kierunkowe. Trzecia część pracy poświęcona została czynom zabronionym charakteryzującym się nieumyślnością. Dokonano analizy elementów obu odmian nieumyślności, ze szczególnym naciskiem na znamię naruszenia reguł ostrożności. W następnej części omawiana jest konstrukcja złożonej strony podmiotowej. Ostatni fragment prezentuje relację pomiędzy stroną podmiotową czynu zabronionego a winą na gruncie obecnych przepisów.

Author analizes particural forms of the subjective aspect of the prohibited act, which occures under the Polish Criminal Code. The master thesis was divided in five parts. In the first one are shown normative conceptions of guilt. The second part was devoted to the construction of prohibited acts which characterized by intent. It was explained the essence of intent, consciousness, motive and guilt. In detail author describes the conceptions explaining the nature of the resultant intent. Next chapter displays varieties of intent construed by the doctrine and still used by the jurisdiction. Addictionally, it was characterized the group of crimes, known as a directional crimes. The third part of the thesis devotes prohibited acts characterized by lack of intent. It was done the analisys of elements both kinds of the unintention with the particular emphasize on trait of breaching the carefulness rules. Next part discusses the construction of the compound subjective aspect. The last one presents relations between subjective aspect of the prohibited act and guilt under the current provisions.
