Geneza sądownictwa konstytucyjnego w Polsce na tle przemian prawno-politycznych

The aim of this paper was to present the history of the constitutional judiciary in Poland. The author makes his performances in various aspects by taking into account a complete description of the problem. Firstly, the paper shows the chronological sequence of events that led to the creation of the Constitutional Court. Secondly, it outlines the legal and political background of these events. Finally, it analyses and evaluates the legitimacy of establishing the Constitutional Court in Poland. The author’s aim is also to confirm the several theses. The first of the theses is the one talking about a long and difficult path leading to the creation of the system of extra-parliamentary supervision of constitutionality of law. The second one finds a significant impact of historical events that occurred in the twentieth century on the process of formation of the Constitutional Court. Finally, it tries to convince the reader about the significant role of this institution in the overthrow of the socialist system.

Celem niniejszej pracy było przedstawienie historii sądownictwa konstytucyjnego w Polsce. Autor mając na względzie pełne przedstawienie problemu dokonuje jego przedstawienia w różnych aspektach. Po pierwsze, przedstawia chronologiczny ciąg wydarzeń które doprowadziły do utworzenia Trybunału Konstytucyjnego. Po drugie, nakreśla prawno-polityczne tło tychże wydarzeń. Wreszcie poddaje analizie i ocenie zasadność utworzenia Trybunału w Polsce. Autor stawia sobie także za cel potwierdzenie szeregu tez. Pierwszą z nich jest ta mówiąca o długiej i niełatwej drodze prowadzącej do powstania systemu pozaparlamentarnej kontroli konstytucyjności prawa. Druga stwierdza znaczący wpływ wydarzeń historycznych mających miejsce w XX w. na proces powstania Trybunału. W końcu próbuje przekonać czytelnika o ważkiej roli tej instytucji w procesie obalania ustroju socjalistycznego.
