Konstytucjonalizacja Ustaw Zasadniczych Izraela

Celem pracy jest próba odpowiedzi na pytanie czy w państwie Izrael doszło do konstytucjonalizacji Ustaw Zasadniczych i podniesienia ich rangi w hierarchii źródeł prawa. W pracy zdefiniowano termin konstytucja, opisano różne jej modele, funkcje, sposoby uchwalania oraz stosowania, a także jej miejsce w hierarchii źródeł prawa. W dalszej części pracy zaprezentowane zostało tło historyczne, polityczne i społeczne istotne dla kształtowania się konstytucjonalizmu w państwie Izrael. Przedstawiono najważniejsze informacje na temat Izraela, jego systemu politycznego oraz uwarunkowań społecznych i religijnych. Opisano proces kodyfikacji Ustaw Zasadniczych oraz działalność Sądu Najwyższego, który odegrał kluczową rolę w procesie konstytucjonalizacji Ustaw Zasadniczych Izraela.

The aim of this paper is to answer the question whether the Basic Laws of Israel have undergone a process of constitutionalization and whether they were elevated in the hierarchy of sources of law. The paper defines the notion of constitution; examines different models of constitution and its functions, methods of enactment and application and also the position of constitution in the hierarchy of sources of law. The paper presents historical, political and social background of the process of constitution-making in Israel. The thesis presents political system of the state of Israel and also social and religious conditions. The paper describes the process of the enactment of the Basic Laws and analyzes the actions of the Israeli Supreme Court which played a major role in the process of constitutionalization of Basic Laws.
