Protection of freedom of assembly in national law and the European Convention on Human Rights

This thesis is to present the problems that are associated with the protection of freedom of assembly. Thesis addresses the issues of protection of freedom of assembly in domestic and international law. Also is shown the historical background of formation of human rights and the protection of these rights in the European Convention on Human Rights. In the first chapter is shown the protection of freedom of assembly in international law. Chapter discussed the problems of protection of freedom of assembly and the solutions adopted by the Court. The second chapter presents the Polish law regulation of freedom of assembly. There is discussed the protection of the rights in the Constitution and the law. Thesis also presents examples of other acts that indirectly regulate freedom of assembly. The last chapter discusses the Polish case of Bączkowski and others vs. Poland before the Court concerning the protection of freedom of assembly. Furthermore, the thesis discussed how to improve the effective protection of freedom of assembly.

Praca magisterska ma na celu przestawienie problemów, jakie wiążą się z ochroną wolności zgromadzeń. W pracy poruszane są problemy ochrony wolności zgromadzeń w prawie krajowym i międzynarodowym. Ponadto ukazany jest rys historyczny tworzenia się praw człowieka i ochrony tych praw w Europejskiej Konwencji Praw Człowieka. W pierwszym rozdziale przedstawiona jest ochrona wolności zgromadzeń w prawie międzynarodowym. Poruszone są problemy ochrony wolności zgromadzeń i ich rozwiązania przyjęte przez Trybunał. W drugim rozdziale przedstawiona jest polska regulacja prawna dotycząca wolności zgromadzeń. Omówiona jest ochrona tego prawa w Konstytucji oraz w ustawie. Podane są przykłady innych aktów prawnych, które w sposób pośredni regulują wolność zgromadzeń. W ostatnim rozdziale omówiona jest polska sprawa Bączkowski i inni przeciwko Polsce przed Trybunałem dotycząca ochrony wolności zgromadzeń. Ponadto w pracy magisterskiej poruszone są kwestie poprawy efektywnej ochrony wolności zgromadzeń.
