A critical analysis of Robert Alexys Theory of Constitutional Rights based on the conflict of the freedom of religion and the freedom of artistic expression.

The thesis describes the conflict between the freedom of religion and the freedom of artistic expression. The first chapter is concerned with the development of both freedoms and their legal bases in both Polish and international legal systems. The second chapter is concerned with Robert Alexy's Theory of Constitutional Rights in general and an in-depth analysis of the theory of rules and the theory of weighing of values along with a critical argument with them. The third chapter is an analysis of two instances of the collision of the aforementioned freedoms, the Georg Grosz's case and the Dorota Nieznalska's case. The two cases are analyzed using the theory of weighing.

Praca magisterska opisuje kolizję zasady wolności religii i wolności ekspresji artystycznej. W rozdziale pierwszym opisany jest rozwój tych wolności oraz ich unormowanie w przepisach prawa polskiego i międzynarodowego. W rozdziale drugim znajduje się Teoria Praw Podstawowych Roberta Alex'ego z szczególnym uwzględnieniem jego teorii zasad oraz formuły ważenia, a także zdania krytyczne na ich temat. Trzecia część pracy omawia dwa przypadki faktyczne kolizji omawianych zasad: sprawę Georga Grosza oraz Doroty Nieznalskiej. Dokonana jest tu próba rozpatrzenia tych spraw pod kątem formuły ważenia.
