Extrajudicial dispute resolution in individual labour law

This thesis presents a characterization of extrajudicial dispute resolution in individual labour law. The terminological chapter explains key concepts for the subject matter: individual employment disputes, alternative dispute resolution, in particular the concept of mediation. In the substantive chapter, presented are: the mediation proceedings pursuant to Articles 183(1) -183(15) of the Code of Civil Procedure, the proceedings before the conciliation commission and mediation proceedings before an arbitration court. These proceedings are based on the mediation method and have been characterized according to the features and functions of mediation. The aim of this study was to show how the aforementioned proceedings fit the idea of mediation.

Praca przedstawia charakterystykę pozasądowego rozwiązywania sporów w indywidualnym prawie pracy. Rozdział terminologiczny wyjaśnia kluczowe pojęcia, ze względu na przedmiot pracy: indywidualne spory z zakresu prawa pracy, alternatywne metody rozwiązywania sporów, a w szczególności pojęcie mediacji. W rozdziale merytorycznym przedstawione zostały: postępowanie mediacyjne w trybie art. 183(1) -183(15) k.p.c., postępowanie przed komisją pojednawczą oraz mediacyjne postępowanie przed sądem polubownym. Postępowania te oparte są na metodzie mediacyjnej, dlatego zostały scharakteryzowane podług cech i funkcji mediacji. Celem tego opracowania było bowiem przedstawienie jak owe postępowania wpisują się w ideę mediacji.
