Procedura wydawania pozwoleń na budowę jako przykład postępowania odrębnego

The purpose of this Master’s thesis is to show the differences between general administrative procedure and building permit, which belongs to special administrative procedure. I am presenting in my thesis there are many visible differences between this two procedures in many fields such as subjects taking part in these procedures, in the course of the proceedings and in the contents of the main act that ends the procedure – the decision of the authority.The first part will focus on subject of building permit procedure. It shows different subjects that are taking part in this procedure such as investor, public administrative authorities (architectural and construction authorities and supervision of building works authorities).The second part presents the course of building permit proceedings and is divided into stages that are combined with different authority’s, investor’s and other subject’s actions.The third part shows the main aspects of the act that is ending building permit procedure – the decision of the authority. It presents not only the normal content’s of the decision but also some additional one that are typical for building permit procedure.The fourth part will focus on one of the most important rules in administrative procedure principle of permanence and exceptions from this rule.

Celem niniejszego opracowania jest ukazanie różnic pomiędzy jurysdyskcyjnym postępowaniem ogólnym a procedurą wydawania pozwoleń na budowę, która należy do postępowań odrębnych w stosunku do ogólnego postępowania administracyjnego. Występuje wiele różnic w zakresie podmiotów występujących w obu postępowaniach, ich przebiegu, modelu decyzji kończącej postępowania czy też związanych z instytucją przełamania ogólnokodeksowej zasady trwałości decyzji występującej w procedurze wydawania pozwoleń na budowę.W pierwszym rozdziale ukazane zostały odmienne w stosunku do kodeksu postępowania administracyjnego uregulowania co do podmiotów biorących udział w postepowaniu o wydanie pozwolenia na budowę wraz ze wskazaniem źródła różnic, tj. art. 28 ust. 2 pr. bud.W drugim rozdziale opisany został przebieg postępowania wraz z podziałem na poszczególne jego etapy. Obowiązki inwestora, działania stron oraz kompetencje organu zostały omówione w zależności od danej fazy postępowania.W trzecim rozdziale nacisk został położony na aspekt materialny oraz formalny decyzji o pozwoleniu na budowę oraz wszelkie uregulowania prawne związane z tym aktem administracyjnym.Rozdział czwarty przedstawia wyjątki od zasady trwałości decyzji administracyjnych. Zaprezentowane w nim zostały instytucje takie jak zmiana przedmiotowa oraz podmiotowa decyzji o pozwoleniu na budowę oraz wygaśnięcie tej decyzji.
