Testament ustny w świetle orzecznictwa Sądu Najwyższego

This Master’s thesis concerns the issue of an oral testament, regulated by article 952 of Civil Code, as one of the specific forms of a testament. There are many practical problems arising from this institution that become a subject of the Supreme Court’s consideration.The thesis includes the analysis of the prerequisites enabling to create an oral testament and formal requirements of this testament, as well as the methods of stating its content.

Niniejsza praca magisterska dotyczy zagadnienia testamentu ustnego, uregulowanego w art. 952 Kodeksu Cywilnego, jako jednej ze szczególnych form testamentu. Na tle tej instytucji powstaje szereg problemów praktycznych, które stanowią przedmiot rozważań Sądu Najwyższego.Praca obejmie analizę przesłanek sporządzenia testamentu ustnego oraz wymogów formalnych tego testamentu, jak również sposobów stwierdzenia jego treści.
