Szczególne uregulowania procesowe dotyczące inwestycji w zakresie lotnisk użytku publicznego

The master thesis relates to the specific investment process regulated by the Act of 12 February 2009 on special rules for the preparation and implementation of investment in airports for public use. The thesis relates primarily to the differences in the investment process introduced a special law airport compared to general laws. The author has analyzed the legal relations the statute and the Code of Administrative Procedure , the Law on real estate , construction law and other legal acts. The work is focused on differences in relation to the regulation of general and takes into account the stage of the investigation , the elements of an administrative decision not to permit the realization of investments in airports for public use and the consequences of the decision. In addition, the analysis is subject to appeal , the proceedings on the annulment of the decision and the possibility of the resumption of the proceedings and the proceedings before the administrative court . Author casts doubt as to the constitutionality of certain provisions of the special act of the airport paying attention to the possibility of a violation of basic civil rights guaranteed by the Basic Law.

Praca dotyczy szczególnego procesu inwestycyjnego uregulowanego w ustawie z 12 lutego 2009 roku o szczególnych zasadach przygotowywania i realizacji inwestycji w zakresie lotnisk użytku publicznego. Praca odnosi się przede wszystkim do różnic jakie w procesie inwestycyjnym wprowadziła specustawa lotniskowa w porównaniu do ustaw ogólnych. Autor poddał analizie relacje prawne specustawy lotniskowej i kodeksu postępowania administracyjnego, ustawy o gospodarce nieruchomościami, prawa budowlanego i innych aktów prawnych. Praca skupiona jest na odmiennościach w stosunku do regulacji ogólnych i uwzględnia etap postępowania wyjaśniającego, elementy decyzji administracyjnej o zezwoleniu na realizację inwestycji w zakresie lotniska użytku publicznego, konsekwencje wydania decyzji zarówno dla inwestora jak i dla podmiotów trzecich. Ponadto analizie jest poddane postępowanie odwoławcze, postępowanie w sprawie stwierdzenia nieważności decyzji oraz możliwość wznowienia postępowania oraz postępowanie przed sądem administracyjnym. Autor poddaje w wątpliwość co do zgodności z Konstytucją niektórych przepisów specustawy lotniskowej zwracając uwagę na możliwość naruszenia podstawowych praw obywatelskich zagwarantowanych w ustawie zasadniczej.
