The rite of an oath of innocence in medieval Poland

Praca koncentruje się na całościowym przedstawieniu zagadnienia rytu przysięgi sądowej w średniowiecznej Polsce. Ryt przysięgi został podzielony na trzy elementy: rekwizyt, gest i rotę. Jego rekonstrukcja oparta jest o analizę komparatystyczną wybranych źródeł o proweniencji polskiej i obcej. Szczegółowe badania nad zagadnieniem rytu stanowią podstawę dla rozważań dotyczących rytualnego charakteru przysięgi sądowej oraz jego związku z sankcją społeczną, jako podstawową karą za krzywoprzysięstwo.

The BA thesis focuses on a comprehensive presentation of the issue of the rite of an oath of innocence in medieval Poland. The structure of such rite is divided into three main parts: the prop, the gesture and the wording of the oath. Its reconstruction is based on a comparative analysis of the historical sources of both Polish and foreign provenance. The keystones of this thesis are the detailed studies on the issue of the rite as the basis for considering the ritual nature of the oath and its relation to a social sanction as the main punishment for the crime of perjury.
