Postępowanie w sprawach ubezpieczeń społecznych jako forma postępowania odrębnego

The aim of this study was to describe the principles which appear in a special procedure in the matters of social insurances (exactly - the proceeding in the matters of benefits and payment of retirement and pension) and present the differences between the special and general administrative procedure. The paper describes the procedure before the Social Insurance Institution, procedural institutions which are characteristic for the special procedure in the matters of social insurances, and appeal proceeding in these matters. The author believes that the appeal to the civil court, instead of administrative court is the best solution for the insured, because the civil court is authorized not only to repeal the decision of Social Insurance Institution, but also to issue a substantive judgment in the matters of social insurances.

Celem niniejszej pracy była próba opisania postępowania w sprawach z zakresu ubezpieczeń społecznych (na przykładzie postępowania w sprawach świadczeń i wypłaty świadczeń objętych ustawą o emeryturach i rentach z Funduszu Ubezpieczeń Społecznych) oraz wskazanie odrębności występujących w niniejszym postępowaniu, w stosunku do ogólnego postępowania administracyjnego. W pracy omówiono jednoinstancyjne postępowanie przed organem rentowym, instytucje procesowe charakterystyczne dla postępowania w sprawach z zakresu ubezpieczeń społecznych, oraz procedurę odwoławczą do sądu powszechnego. Pozytywnie oceniono poddanie kontroli decyzji organu rentowego sądowi powszechnemu, który w przeciwieństwie do sądu administracyjnego, może orzekać również merytorycznie w sprawach z zakresu ubezpieczeń społecznych.
