Literary character in Polish copyright law

The objective of this master’s dissertation is approximation of the scope of protection literary hero within the Polish copyright law and demonstration on which planes literary figure is subject to copyright protection. It clarifies the conditions, which literary figure must satisfy, in order to gain a separate, independent from the whole work protection and also presents principles of protection of the literary hero in the whole work. The author wished to demonstrate that copyright protection should not be limited to the whole work, but its scope might include single elements.

Praca magisterska ma na celu przybliżenie zakresu ochrony bohatera literackiego w ramach polskiego prawa autorskiego oraz wykazanie, na jakich płaszczyznach postać literacka podlega ochronie prawnoautorskiej. Przybliżono w niej warunki, które musi spełniać ten element dzieła, aby mógł zyskać osobną, niezależną od całości utworu ochronę oraz szczegółowo zaprezentowano zasady ochrony bohatera w obrębie całego dzieła. Autor chciał w ten sposób wykazać, że ochrona prawnoautorska nie powinna ograniczać się do całości utworu, lecz może swoim zakresem indywidualnie obejmować poszczególne jego elementy.
