United Nations peacekeeping operations in the context of contemporary challenges of international humanitarian law of armed conflict

The purpose of this thesis is to present the issue of United Nations peacekeeping operations in the context of contemporary challenges of international humanitarian law of armed conflicts. In the first part, the thesis briefly discusses the history and functioning of the United Nations to facilitate the understanding of the process of launching peacekeeping operations. Analysis was also supported by examples of types of peacekeeping operations. Further steps were taken to resolve the fundamental issue that UN peacekeepers are obliged by international humanitarian law. The examples of specific peacekeeping operations helped to discuss the usefulness and application of the two branches of the law: the law of military occupations, and the provisions on protection of civilians. The conclusion of the thesis is an attempt to assess the efficiency and effectiveness of peacekeeping operations under the aegis of the UN.

Celem niniejszego opracowania jest przedstawienie problematyki operacji pokojowych ONZ w kontekście współczesnych wyzwań międzynarodowego prawa humanitarnego konfliktów zbrojnych. W pierwszej części pracy krótko omówiono historię i sposób funkcjonowania Narodów Zjednoczonych, by ułatwić zrozumienie procesu powoływania operacji pokojowych. Analizie popartej przykładami poddano też rodzaje operacji pokojowych. W dalszej kolejności starano się rozstrzygnąć fundamentalną kwestię związania sił pokojowych ONZ międzynarodowym prawem humanitarnym. Na przykładzie konkretnych operacji pokojowych omówiono przydatność i możliwość zastosowania dwóch działów tego prawa: prawa okupacji wojennej i przepisów dotyczących ochrony ludności cywilnej. Zakończenie pracy jest próbą oceny sprawności i skuteczności działania operacji pokojowych prowadzonych pod egidą ONZ.
