Odwołanie w postępowaniu administracyjnym

The subject of the thesis is an appeal in the administrative proceedings. In the first chapter was explained the concept of legal measures, I have presented their different division. I have mentioned and discussed as well other existing alongside appeal oridinary legal measures. The second chapter describes the appeal as a reference to the higher authority. I pointed out in this part the conditions of admissibility of an appeal, entities authorized for the appeal and the authorities which are competent for its consideration. In this chapter, I have indicated the requirements and the deadline for lodging an appeal. In the third chapter I explain how the whole process of an appeal looks like . I describe the course of proceedings at first and second instance and the types of decisions issued by the appellate body. I have presented as well the ban on deterioration of the legal situation of the party, which applies to the review body, which is responsible for passing the decision.

Tematem pracy jest odwołanie w postępowaniu administracyjnym. W pierwszym rozdziale zostało wyjaśnione pojęcie środków prawnych, dokonany został ich podział oraz omówione inne występujące obok odwołania środki prawne zwyczajne. Drugi rozdział przedstawia odwołanie jako środek odwoławczy. Wskazane są w nim przesłanki dopuszczalności wniesienia odwołania, podmioty uprawnione do jego wniesienia oraz organy, które są właściwe do jego rozpatrzenia. W rozdziale tym wskazane są również wymogi i termin do wniesienia odwołania. W trzecim rozdziale wyjaśniono w jaki sposób odbywa się cały proces odwoławczy. Opisany został tok postępowania przed organem I i II instancji oraz rodzaje decyzji wydawanych przez organ odwoławczy. Przedstawiony jest w nim również zakaz pogarszania sytuacji prawnej strony, który obowiązuje organ odwoławczy przy wydaniu decyzji.
