Solidarność dłużników

Niniejsza praca traktuje o solidarności dłużników. Celem niniejszej pracy jest ukazanie najbardziej charakterystycznych cech solidarności biernej i odpowiedź na pytanie czy w polskim systemie prawnym realizowane jest główne założenie tej konstrukcji. Solidarność dłużników na celu ma zabezpieczenie praw wierzyciela i ochronę obrotu prawnego, co sprawia, że tematyka ta jest nie tylko interesująca, ale przede wszystkim niezwykle aktualna. W niniejszej pracy zostały ukazane najważniejsze zalety i wady solidarnej odpowiedzialności dłużników. Szczególnie ważnym zagadnieniem, w kontekście położenia dłużników, jest więź łącząca dłużników solidarnych oraz ich niezależność. Zagadnienia te zostały omówione w rozdziałach 3 i 4. Tematyka dotycząca solidarności dłużników zmusza również do poruszenia bardzo ważnego zagadnienia jakim jest odpowiedzialność in solidum. Konstrukcja ta została opisana w ostatnim rozdziale. W pracy omówione zostały również między innymi źródła solidarności dłużników oraz powstanie i realizacja roszczeń regresowych.

Present thesis concerns the debtors’ solidary liability. The aim of this study is to show the essential features of this construction and, moreover, to answer to the question whether the Polish legal system is realized the main idea of solidary liability - protection of creditor rights. The main premise of this legal construction makes the subject interesting and exceptionally live. In this paper are shown the main advantages and disadvantages of liability of the debtors. A particularly important issue in the context of the situation of debtors is the link between debtors and, on the other hand, their independence. These issues are described in Chapters 3 and 4. Discussion of debtors’ solidarity also forced to raise a very important subject - in solidum liability. This structure is described in the last chapter. The study also discussed, among others, the source of solidarity and recourse between solidary debtors
