Skarga pauliańska, ze szczególnym uwzględnieniem sytuacji osoby trzeciej

Praca magisterska koncentruje się na problemach dotyczących stosowania przepisów o skardze pauliańskiej (art. 527 k.c. i n.) w stosunku do osoby trzeciej, która dokonała fraudacyjnej czynności z dłużnikiem, wskutek czego doszło do pokrzywdzenia wierzyciela. W pracy dokonano analizy przesłanek jakie muszą wystąpić, aby wierzyciel mógł skutecznie dochodzić uznania takiej czynności za bezskuteczną, a następnie przedstawiono podstawowe problemy jakie pojawiają się zarówno na etapie postępowania sądowego jak i egzekucyjnego. Na koniec zostaje poruszona problematyka odpowiedzialność osoby trzeciej z innych przepisów prawa cywilnego, w sytuacji gdy dokonuje ona rozporządzeń korzyścią majątkową uzyskaną od dłużnika.

The master's thesis focuses on the application of regulations problems' about actio pauliana (in the meaning of the provisions of the Civil Code, Article 527 and the following) related to the situation of third party, in which the third party commits the act of embezzlement with the debtor, as a result the creditor's detriment arrives. The thesis analyses statutory requirements in terms of the creditor's vindication and the recognition of the act as ineffective, then there are shown the the basic appearning problems, both in legal and enforcement proceedings. Finally, third party responsibility isssues are considered, relating to other civil law regulations, in the situation where the third party disposes financial benefits obtained from the debtor.
