Universal service in telecommunications law

Celem pracy jest przedstawienie problematyki usługi powszechnej na tle krajowych uregulowań oraz obecnej sytuacji na rynku telekomunikacyjnym. Pierwszy rozdział pracy prezentuje pojęcie prawa telekomunikacyjnego oraz jego źródła, zarówno krajowe jak i unijne. Drugi rozdział charakteryzuje krajowy organ regulacyjny sektora telekomunikacyjnego, przedstawia procedurę postępowania przed nim, a także porusza problematykę wykonywania telekomunikacyjnej działalności gospodarczej. Trzeci rozdział dotyczy podstawowych dokumentów prawnych w oparciu o które świadczone są usługi telekomunikacyjne użytkownikom końcowym. Czwarty rozdział wskazuje na przepisy regulujące usługę powszechną, prezentuje jej pojęcie oraz zakres, a także porusza problematykę wyboru operatora wyznaczonego i jego obowiązków z tym związanych. Rozdział piąty prezentuje ocenę dostępności, jakości świadczenia i przystępności cenowej usług wchodzących w skład usługi powszechnej na krajowym rynku telekomunikacyjnym.

The aim of this thesis is to present the issue of universal service in the background of national regulations and the current situation in the telecommunications market. The first chapter of the thesis presents the concept of telecommunications law and its sources, both national and EU. The second chapter characterises the national regulatory authority of the telecommunications sector, presents the procedure to be followed before it and brings the issue of the running telecommunications business up. The third chapter is concerned with basic legal documents based on which telecommunications services are provided to end users. The fourth chapter indicates the rules regulating universal service, presents its concept and scope and brings the issue of choice the designated operator up and its obligations in this area. The fifth chapter presents an assessment of the availability, quality of provision and affordability of services included in the universal service in the domestic telecommunications market.
