Służba Więzienna w ujęciu doktrynalnym, normatywnym oraz funkcjonalnym - wybrane aspekty

The subject of the thesis concerns selected aspects of functioning of Prison Service from doctrinal, normative and functional perspective.The paper presents axiological basis of organization and activity of Prison Service, which has its groundwork in Polish legislation and international law. There have been shown the values, which should be included by the officers and civil workers of Prison Service during obeying their official duties, such as humanitarianism and respecting the human dignity of prisoners.The paper presents the organizational structure as well as the tasks of the Prison Service. There have been presented issues concerning the status of officers and civil workers of this formation. The paper describes establishing and cessation of employment, official positions as well as grades and corpuses in Prison Service. The paper also shows the entitlements of the prison officers connected to their official duties.The last part of this paper describes the practical aspects of functioning of Prison Service. It presents the statistics showing inter alia educational status of prison staff and personnel structure in penitentiary and security departments. There has been discussed the paramilitary nature of Prison Service and its negative effect on efficiency of implementation of imprisonment penalty. The paper also presents prison officers’ psychophysical condition and the stress related to rendering the service in penitentiary units.

Przedmiotem pracy magisterskiej są wybrane aspekty funkcjonowania Służby Więziennej w ujęciu doktrynalnym, normatywnym i funkcjonalnym.Omówione zostały podstawy aksjologiczne organizacji i działalności Służby Więziennej, znajdujące swe podłoże w ustawodawstwie polskim oraz zaleceniach i aktach prawa międzynarodowego. Wskazano na wartości, jakimi powinni kierować się funkcjonariusze i pracownicy cywilni Służby Więziennej podczas wykonywania swoich obowiązków, takie jak humanitaryzm i poszanowanie godności ludzkiej osób odbywających karę pozbawienia wolności.W pracy zaprezentowano problematykę dotyczącą struktury organizacyjnej oraz zadań Służby Więziennej. Przedstawiono kwestie związane ze statusem funkcjonariuszy oraz pracowników cywilnych tejże formacji. Omówiono materię obejmującą nawiązywanie i ustanie stosunku służbowego funkcjonariuszy, stanowiska służbowe oraz stopnie i korpusy w Służbie Więziennej. Przedstawiono także uprawnienia funkcjonariuszy związane z wykonywaniem obowiązków służbowych. W ostatniej części niniejszego opracowania ukazane zostały praktyczne aspekty funkcjonowania Służby Więziennej. Przedstawiono statystykę związaną m. in. z poziomem wykształcenia kadry więziennej oraz strukturą personalną działów penitencjarnych i ochrony. Omówiono charakter paramilitarny Służby Więziennej i jego negatywny wpływ na efektywność wykonywania kary pozbawienia wolności. Wskazano również na kondycję psychofizyczną funkcjonariuszy oraz na stres związany z pełnieniem służby w jednostkach penitencjarnych.
