Pojęcie inwestycji w międzynarodowym prawie inwestycyjnym

This master thesis presents the problem of the interpretation of the notion of 'investment' in international investment law. The first part of this work concerns historical development of the protection of investments made by foreign investors. Next part touches upon the issues of defining 'investment' in the bilateral investment treaties and their influence on the jurisdiction of the tribunal under the Convention on the Settlement of Investment Disputes between States and Nationals of Other States and bilateral investment treaties. A significant portion of considerations relates to the methods of interpreting foreign investor's activity as an investment, with special regard to the concepts present in doctrine and judicature. Final chapter pertains to particular controversies existing in investment law, such as temporal and territorial requirement of investment and many other untypical situations relating to the notion of 'investment'.

Niniejsza praca przedstawia problem interpretacji pojęcia inwestycji w międzynarodowym prawie inwestycyjnym. W pierwszej części pracy przedstawiono historyczny rozwój ochrony inwestycji zagranicznych inwestorów. Dalsza część pracy traktuje o techniczno-prawnych i jurysdykcyjnych problemach terminu inwestycji. W tym miejscu omówione zostały metody definiowania pojęcia inwestycji w traktatach inwestycyjnych oraz kwestie jurysdykcyjne związane z inwestycją, tak w reżimie prawnym Konwencji waszyngtońskiej o rozstrzyganiu sporów inwestycyjnych między państwami i obywatelami innych państw, jak i w ramach prawnych stworzonych przez dwustronne umowy o popieraniu i wzajemnej ochronie inwestycji. W głównej części pracy przedstawiono sposoby interpretacji działalności inwestorów jako inwestycji w rozumieniu traktatów inwestycyjnych, z uwzględnieniem poglądów orzecznictwa i doktryny. Ostatni rozdział pracy porusza kwestie szczególne dotyczące inwestycji, m.in. temporalne i terytorialne aspekty inwestycji oraz wiele innych nietypowych sytuacji.
