The offence of the religious feelings in Polish Criminal Code. Dogmatic analysis in the context of the states relation to religion

The subject of this thesis is the crime of the offence of the religious feelings in polish criminal law (article 196 of Polish Criminal Code). Besides an extensive dogmatic analysis it contains the consideration connected with the relation between state and religion, the exclusion of the perpetrator's criminal liability (the art contratype in particular) and legal comparative aspects. Furthermore this thesis raises the subject of legitimacy and permissibility of criminalization of the offence of the religious feelings.

Tematem niniejszej pracy jest przestępstwo obrazy uczuć religijnych w polskim prawie karnym (art. 196 kodeksu karnego). Oprócz obszernej analizy dogmatycznej zawiera ona rozważania dotyczące problematyki związanej ze stosunkiem państwa do religii, wyłączenia odpowiedzialności karnej sprawcy (w szczególności tzw. kontratypu sztuki), a także aspekty prawnoporównawcze. Ponadto w pracy poruszona jest tematyka związana z zasadnością i dopuszczalnością kryminalizacji obrazy uczuć religijnych.
