Maintenance benefits granted based on the act from 7 September 2007 about the help entitled to maintenance and the principle of enforcing them from maintenance debtors

The purpose of this study was to describe the process consisting in granting authorised persons of benefits from the maintenance fund and next them is a purpose of this work enforcing from the maintenance debtor. The maintenance obligation is a legal institution which is supposed to ensure means of support, but if necessary means of bringing up, for these family members, which aren't able to sate with own powers of one's justified needs. Relatives in the direct line, as well as siblings are burdened with this obligation. However it often turns out that family members aren't able to grant such a help to family and friends being in need, because don't have a competence or the tangible property more means needs than a moral obligation for family and friends in the need. In such a situation with the help authorised a law is coming.The work consists of five chapters in which one by one presented: being of the maintenance relationship, legal sources regulating the maintenance obligation, procedure of acting about granting benefits based on the act on the help to persons entitled to maintenance, procedure of enforcement proceedings conducted by the bailiff, as well as acting on enforcing from debtors maintenance benefits.

Celem niniejszej pracy jest przedstawienie procesu polegającego na przyznawaniu osobom uprawnionym świadczeń z funduszu alimentacyjnego oraz następnie ich egzekwowanie od dłużnika alimentacyjnego. Obowiązek alimentacyjny jest instytucją prawną, która ma zapewnić środki utrzymania, a w razie potrzeby środki wychowania, tym członkom rodziny, którzy nie są w stanie własnymi siłami zaspokoić swoich usprawiedliwionych potrzeb. Obowiązkiem tym obciążeni są krewni w linii prostej, a także rodzeństwo. Jednak często okazuje się, że członkowie rodziny nie są w stanie udzielić takiej pomocy będącym w potrzebie bliskim, dlatego że nie mają dostatecznych środków albo dobra materialne więcej znaczą niż moralny obowiązek potrzeby bliskim w potrzebie. W takiej sytuacji z pomocą uprawnionym przychodzi prawo. Praca składa się z pięciu rozdziałów w których kolejno przedstawiono: istotę stosunku alimentacyjnego, źródła prawne regulujące obowiązek alimentacyjny, procedurę postępowania o przyznawaniu świadczeń na podstawie ustawy o pomocy osobom uprawnionym do alimentów, procedurę postępowania egzekucyjnego prowadzonego przez komornika sądowego, a także postępowanie w sprawie egzekwowania od dłużników alimentacyjnych świadczeń.
