"Joint and several" liability of an investor to subcontractors (Article 647[1] of civil code)

Praca opisuje odpowiedzialność inwestora względem podwykonawców na gruncie kodeksu cywilnego. W szczególności przedmiotem pracy jest analiza pojęcia odpowiedzialności solidarnej i jego znaczenia na gruncie art. 647[1] k.c. W pierwszej części pracy analizowana jest problematyka solidarności w ogólności oraz jej relacja do instytucji akcesoryjności. W drugiej części pracy analizowany jest wpływ zobowiązania generalnego wykonawcy na odpowiedzialność inwestora. Trzecia część pracy dotyczy obrony inwestora względem podwykonawców. Ostatnia, czwarta część zajmuje się roszczeniami regresowymi pomiędzy podmiotami w procesie inwestycyjnym. Głównym problemem pracy jest to, jakie przepisy o solidarności znajdują zastosowania do odpowiedzialności inwestora.

The Thesis addresses the issue of liability of an investor to subcontractors under polish civil code. In particular the subject matter of the thesis is the analysis of the concept of joint and several liability and its meaning under Article 647[1] of polish civil code. First part is the overall analysis of joint and several liability as an institution of civil law and its relation to accessory liability. Part two addresses the issue of relation between general contractor's obligation to pay subcontractors and investor's liability. Part three addresses the defense of an investor against subcontractors. Last but not least, part four is the analysis of recourse claims in the investment process. The main issue of the Thesis concerns the scope of application of the rules governing joint and several liability, and in particular which can be applied to investor's liability under Article 647[1] of polish civil code.
