Podobieństwo znaków towarowych w prawie i orzecznictwie krajowym i unijnym.

By virtue of limited identifiers which may be considered as trademarks, similar marks exist on the market. Such similarity often results with a situation, when a mark does not carry out its primary function of indicating the commercial origin of the goods. This kind of situations generate disputes between trademark holders, which are settled, inter alia, on the basis of the assessment of the similarity of the marks carried out by the relevant authorities. The thesis presents the problem of similarity of the marks in national and European regulations and case-law. The basis for the considerations on the similarity between the marks is a detailed overview of a trademark, made by analyzing its definition and its interpretation by scholars. The core of the thesis covers the matter of similarity of the marks, which are situations, when such assessment is made and the assessment process itself. The thesis is supplemented by the examples of the case-law.

Ze względu na ograniczone zasoby identyfikatorów, które mogą pełnić rolę znaku towarowego na rynku występują znaki podobne. Często jednak podobieństwo znaku do innych oznaczeń występujących na rynku powoduje, że przestaje on realizować swą podstawową funkcję wskazywania na komercyjne źródło pochodzenia towaru. Sytuacje takie generują pomiędzy uprawnionymi do znaków towarowych spory, które rozstrzygane są m.in. na podstawie przeprowadzonej przez odpowiednie organy oceny podobieństwa. Praca prezentuje problematykę podobieństwa znaków towarowych w prawie i orzecznictwie polskim i europejskim. Za podstawę do rozważań na ten temat przyjęte zostało szczegółowe omówienie istoty znaku towarowego, analiza jego definicji i jej interpretacja w doktrynie. Trzon pracy stanowi omówienie tematu podobieństwa znaków towarowych. Opisane zostały sytuacje, w których do oceny podobieństwa dochodzi oraz sam przebieg takiej oceny. Proces oceny podobieństwa oraz jego teoretyczne założenia został uzupełniony o przykłady z orzecznictwa sądów polskich i europejskich.
