Current national and Christian churches legislation in Poland regarding burials and its influence on the preservation of historic religious cemeteries

Celem niniejszej pracy jest omówienie aktualnego prawodawstwa państwowego i Kościołów chrześcijańskich w Polsce w sprawie pochówków i jego wpływu na zachowanie zabytkowych cmentarzy wyznaniowych. Tekst zaczyna się od pokazania roli i wartości cmentarzy w świadomości społeczeństwa oraz ukazania wyzwań i problemów dotyczących ochrony tych założeń. Analizie poddano prawodawstwo państwowe oraz prawo kanoniczne dotyczące cmentarzy i ich ochrony, a także warunki jakie należy spełnić, aby zlikwidować cmentarz, omówiono dokumenty takie jak np. regulaminy cmentarzy. W pracy rozważa się także zagadnienia związane z wierzeniami teologicznymi dotyczącymi śmierci, grobu i ciała.

The aim of this study is to describe current national and Christian churches legislation in Poland regarding burials and its influence on preservation of historic religious cemetery. Text begins with shows importance and value of the cemetery in the social consciousness and challenges and problems concerning the protection of these assumptions. National legislation and canon law on cemeteries and their protection were analyzed, as well as the conditions to be met in order to eliminate the cemetery. Documents such as the regulations of cemeteries were discussed.The paper examines issues related to theological beliefs about death, grave, and relics.
